WELLORS TERMS OF USE
These Terms of Use ("Terms") constitute a legally binding agreement between you, as an individual user or service provider ("User," "you," or "your"), and Unique Craft LLC dba Wellors ("Wellors," "we," "us," or "our"), regarding your use of the Wellors website, mobile application (collectively, the "Platform"), and the on-demand wellness services facilitated through the Platform.
BY ACCESSING OR USING THE PLATFORM OR THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE PLATFORM OR THE SERVICES.
1. The Wellors Platform and Services
1.1 Description of Services
Wellors provides a technology platform that connects customers ("Clients") seeking on-demand wellness massage services with independent, certified, and licensed massage therapists ("Providers") in Clients' homes, offices, or hotels.
1.2 Independent Contractor Relationship
Wellors is strictly a technology platform and service facilitator. Providers are independent contractors, not employees, partners, agents, or joint ventures of Wellors. Wellors does not control, supervise, or direct the services provided by the Providers, and Wellors is not responsible for the Providers' acts, omissions, or compliance with any laws, rules, or regulations, including those related to the California Massage Therapy Act (CMTA).
1.3 Nature of Wellness Services
The services provided through the Platform are for professional wellness, relaxation, recovery, and overall well-being only.
THESE SERVICES ARE NOT, AND ARE NOT INTENDED TO BE, MEDICAL TREATMENTS, MEDICAL DIAGNOSES, OR SUBSTITUTE FOR PROFESSIONAL HEALTHCARE.
1.4 Geographic Scope
At present, Wellors services are available only within the State of California. You agree not to book or attempt to book services outside of this jurisdiction.
2. User Accounts and Eligibility
2.1 Account Creation
To access and use the Platform's booking and services features, all Clients must register and create a personalized account ("Account"). You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
2.2 Security
You are responsible for maintaining the confidentiality of your Account password and are fully responsible for all activities that occur under your Account.
2.3 Eligibility
The Platform is intended solely for Users who are 18 years of age or older.
3. Financial Terms and Payment
3.1 Pricing Structure
All prices are displayed on the Platform. The total cost for a 60-minute session includes:
- Service Fee: $149.00
- Operational Fee: $4.95 (covers trust & safety, background checks, provider monitoring, and customer support)
- Automatic Gratuity: 18% of the Service Fee, which is paid directly to the Provider
3.2 Transparency
The full, final price (including Service Fee, Operational Fee, and Gratuity) will be presented to the Client at the time of booking. There are no hidden charges.
3.3 Payment Processing
All transactions are cashless and handled by a secure, PCI-compliant third-party payment processor. Wellors does not store sensitive cardholder data.
- Client Charges: Clients will be charged for the session immediately following its completion, or if applicable, when cancellation fees are incurred.
- Provider Payments: Providers are paid weekly via direct deposit for services rendered and eligible compensation.
3.4 Automatic Gratuity
An automatic 18% gratuity is included in the total booking cost and is paid directly to the Provider. Cash tips are not required or expected.
4. Cancellation and Refund Policy
4.1 Client Cancellation Policy
Client cancellations must be submitted through the Platform. If a Client cancels a confirmed booking, the following cancellation fees, calculated based on the $149.00 Service Fee, will apply:

4.2 Early Session Termination (Client)
If a session is stopped early at the request or initiation of the Client, the full charge for the scheduled session applies, and no refund will be provided.
4.3 Refunds
Refunds are only issued in accordance with the cancellation policy outlined in Section 4.1.
4.4 Provider Cancellation/Compensation
If a Provider cancels a confirmed booking, Wellors will compensate the Provider as follows, based on the $149.00 Service Fee:
- Cancellation Greater than 6 hours before: The Provider receives no compensation ($0.00).
- Cancellation Between 6 hours and 2 hours before: The Provider receives compensation equal to 30% of the Service Fee ($44.70).
- Cancellation Less than 2 hours before or No-Show: The Provider receives compensation equal to 60% of the Service Fee ($89.40).
5. Trust, Safety, and User Conduct
5.1 Provider Certification and Compliance
All Providers utilizing the Platform are required to hold valid certification from the California Massage Therapy Council (CAMTC) and must abide by all regulations set forth by the California Massage Therapy Act, including professional conduct, sanitation, and proper draping protocols.
5.2 Required Disclosure (Client)
Clients must disclose any allergies, medical conditions (including pregnancy, pre-existing injuries, or severe health issues), or physical limitations to the Provider before the session begins.
5.3 Unsafe/Inappropriate Environment or Conduct
- Wellors has a zero-tolerance policy for unsafe, inappropriate, illegal, or abusive behavior.
- If a Provider deems the environment unsafe (e.g., inadequate space, extreme temperature, lack of privacy) or the Client's conduct inappropriate (e.g., harassment, explicit requests, or any behavior that violates the CMTA), the Provider is authorized to immediately terminate the session.
- In the event of termination due to unsafe environment or inappropriate Client conduct, the full charge applies, and no refund will be issued.
5.4 Exclusivity of Booking
All bookings for services facilitated by the Platform must be made exclusively through the Wellors Platform. Users and Providers agree not to solicit or accept off-platform bookings or payments. All transactions must be cashless.
6. Health Disclaimers and Limitation of Liability
6.1 Health Disclaimers
- Non-Medical Advice: The wellness services provided are not a substitute for professional medical care, diagnosis, or treatment.
- Pre-Existing Conditions: Wellors is not responsible for any adverse reactions, injuries, aggravation of pre-existing conditions, or health issues arising before, during, or after a session.
- Consultation: Clients are solely responsible for consulting with their physician prior to receiving any massage service, particularly in cases of pregnancy (Baby, Prenatal, Postnatal services), chronic illness, or recent injury.
6.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WELLORS (INCLUDING ITS AFFILIATES AND LICENSORS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
6.3 Aggregate Liability
In no event shall Wellors's aggregate liability to you for all claims arising out of or related to these Terms or your use of the Platform/Services exceed the greater of (A) the amounts paid by you to Wellors in the six (6) month period preceding the event giving rise to the liability, or (B) ONE HUNDRED U.S. DOLLARS ($100).
7. Indemnification
You agree to indemnify, defend, and hold harmless Wellors and its parent company (Unique Craft LLC), officers, directors, employees, agents, and Providers from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (i) your access to or use of the Platform or Services; (ii) your breach of these Terms; (iii) your violation of any third-party right, including without limitation any intellectual property or privacy right; or (iv) any claim that your conduct caused damage to a third party.
8. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions. You agree to the personal and exclusive jurisdiction of the state and federal courts located in Santa Clara County, California, for any disputes arising out of these Terms.
